thanks for being with us. greta van susteren is standing by to go on the record. see you tomorrow night. >> greta: this is a fox news alert. massive earthquake has rocked the country of haiti. the quake measuring 7.0 on the richter scale hit before 5 p.m. eastern time. it hit 10 miles southwest of the capital port-au-prince. u.s. officials tell the associated press bodies are lying in the streets and the scene is total disaster and chaos. witnesses describe hearing cries for help among the rubble. large hospital collapsed. several aftershocks have rocked the region one 5.9. this is the worst earthquake to hit haiti in more than 200 years. the shaking was felt in the dominican republic, jamaica and cuba. no reports on damage or casualties. buildings are flimsy and the

death toll is expected to be high. at this hour, power and communications are down throughout the country. information continues to come in to fox news. we'll bring you the latesthon breaking news as we get it. tonight, he blasted. a u.s. senator gets blasted at a town hall meeting. wisconsin senator feingold getting an earful at a town hall. >> if you need help also helping the poor, i'm not against that or the illegals. but maybe you could use the leftover stimulus money that might help. [ applause ] >> i think that these proceedings should absolutely be on c-span. i think it is stupid to not do it. the finance meetings were televised. the senate proceedings, the votes were televised. and there should be as much transparency -- >> do you agree?

>> i do. >> we have sent you e-mails faxed information and we get no response from your office. [ applause ] >> you mentioned financial transactions. i was concerned this summer at town meetings people said there were provisions that allowed personal bank accounts to be accessed. we checked, there is no language that does that they put special language in the financial committee bill and senate bill to make sure that wouldn't happen. my understanding -- >> irs! >> my understanding that isn't a concern. in fairness, because you did raise the issue of the -- i'm not sure for sure whether the supreme court will approve that piece. i think they will. i think they will. i think they will. i would not vote for it if i believed it would be struck down. the authors of the bills are crazy if they put a provision that going to be struck down by the supreme court. then they would be back to zero.

certain about the constitutionality of the response to your question or not? tell us what your question was. >> no, he was not. what i did was, i recited briefly the intentions of the founders to put restrictions on the power of the federal government. then quoted the 4th, 9th and 10th amendments to the constitution. and asked him in light of this, how in the world this health care bill is passed by the senate could be consistent with the constitution of the united states? >> greta: and the senator said what to you, sir? >> the senator said that he thought that it was constitutional. that the only reservation he had was the individual mandate that's in the bill. he said that would probably have to go to the supreme court. but he believed that the supreme court would approve it as being constitutional. >> greta: about how many

people were present at this town hall meeting? >> by my guess around 280. there's 240 seats in the hall plus roughly 40 people standing either by the walls or sitting in the aisles. all the seats were filled. >> greta: it is considered a conservative area do you consider yourself republican, democrat, independent? >> i'm an active member of the republican party of waukesha county. >> greta: what percentage in the room were republicans and what percentage were democrats? >> i have no idea, but i do know that someone else took a straw poll of how many people favored this piece of legislation and how many were opposed. there were exactly 12 people in favor of it and everyone else opposed. so that would be roughly 90% opposed and 10% supporting. >> greta: how about the

senator -- you grilled that senator pretty much. how did he do? >> he was very cool, very professional. obviously, he knew that it would be foolish to express any anger or rancor or resentment. he knew that he was in territory where his position was heavily outnumbered in the population. only 35% of the vote the last time around. in waukesha county >> greta: craig, thank you for joining us. joining us now is joe petry reporter for the waukesha freeman. you covered the town hall meeting? >> yes, i did. >> greta: tell me a little about the community, tell me about the reaction, how the senator did? >> the senator surprisingly he didn't lose his temper as much as somebody you would think

would that was being -- the way the answers were coming at him. basically, people there were very passionate. they were crowded in to the ampitheater. they were sitting in the halls. they were even outside, they were all over the place. they were mad. i mean, everyone was saying something as soon as he would have something he would say. >> greta: why do you think senator feingold chose that community? if he stayed in madison he would have had a lot friendlier crowd. that's a very conservative community. why did he take that one? >> the thing with senator feingold, one he's not someone who is afraid to go and talk to a community that is against him. secondly, since he was first elected in the early 90s has had this where egos to every county during the year, to -- where he guess to every county during the year to have these

meetings. the this time around people are passionate in the past these meetings would have drawn 12 people as opposed to two, three hundred. >> greta: did he say with certainty he's going to volt for health care contained in the current bill? did he have any reservation at all? >> he said no bill is perfect. but he believes it could be brought better into perfection. he's indicated that he's willing to vote for it. but he does want to see some changes. >> greta: what about the part where the constitutional question whether or not it is constitutional to require people to get insurance? sounds like the senator is a little uncertain as to what would happen with that. would have to wind up to the supreme court. he thinks it is constitutional but there is some level of uncertainty. >> yeah, he did seem to have a little bit of uncertainty about it. but at the same time, he did

-- he is standing behind it that it is something he believes should be at least investigated. >> greta: did anyone ask about the deal nebraska the 300 million dollar deal why feingold couldn't get one for the dairy state? >> he said that wisconsin could possibly get a better deal than the one that was out there. but he did not elaborate on what it would be. >> greta: joe, thank you for joining us. >> thank you. >> greta: this is a fox news alert. new video just coming in of this massive earthquake that rocked haiti. the quake measuring 7.0 on the richter scale struck about 10 miles southwest of the capital of port-au-prince. the damage as you can see is catastrophic. large parts of the country tonight in total darkness, bodies reportedly lying in the street. the worst, people screaming for help in the rubble. this is the worst earthquake to hit haiti in more than 200

>> greta: the agency that runs medicare has issued a warning. what is that warning? is anyone listening? steve moore joins us live. steve is the senior economic writer for the "wall street journal" editorial page. center for medicare and

medicaid service has a warning what is it? >> this bill is going to cost more than expected. this bill was intended to cut the costs of the health insurance system so we could all afford greater access to health care. what this medicare actuary said it is going to what they call ben the cost curve up to state cost will rise over time they won't fall down. that's what mr. obama said. they project over the next 10 years that the increase in the cost of medicare is going to be 200 billion dollars that a big number twice the size of the california budget. >> greta: is that in contrast to what the congressional budget office said? >> a higher number. >> greta: now we've got two very different numbers. did they use different methodology at arriving at the numbers? >> medicare they think the cost are going to accelerate more. remember there's two parallel programs there's medicare they didn't look at medicaid they are going to be doing that in

the next couple of s. medicaid has a vast expansion there's 10 to 15 million more americans that will be under the medicaid system. here's why this is an important point i think the viewers need to understand this medicare and medicaid are already bankrupt, technically. they have massive multi-trillion dollar unfunded liability. what i find observing able to this bill and the warning the actuary was making was wait a minute this bill doesn't reduce long term liabilities it increases them substantially in the hundreds of billions of dollars. that means the date by which medicare and medicaid are totally bankrupt moves closer. tkpret get is anyone paying attention to this -- >> greta: is anyone paying attention to this? >> no. i think what is going on was reflected by your last segment. the more the person people -- increasingly unpopular with each passing day as people start to -- one of the reasons

the information is trickling out because they wouldn't tell us what is in the bill. >> greta: a poll shows more people like this bill? >> i didn't see that you might be right but i've been tracking polling the last couple of months and it has shown a steady decline in popularity that's a big problem. that's a reason they feel so ed to get this done before the support -- so rushed to get this done before the support falls. >> greta: i don't know anyone can be for this or against this when it is done behind closed doors. we don't know what is in it. i'm still distressed yesterday about the president meeting with the labor unions about those cadillac tax still nothing on it. was a deal cut? why was it done behind closed doors? someone is being flim-flammed big time. >> i think you talking about in night after night has an impact. people are why this is being done behind closed doors.

>> greta: it is our money and we sit there like a potted plant and divvies -- as everyone sits and divvies up our money. >> one point with respect to that issue of the constitutionality. i find it highly objectionable that a lot of these members of the house and senate are about to vote, yes on a bill where you have a major provision that looks to be unconstitutional. i would ask russ feingold if he were here, point to me in the constitution that section of the constitution where it says the united states has the government to force people to buy insurance? it is not in there. the constitution is a very straightforward document about what the powers of the government are. that's not in there. >> greta: interesting supposedly we don't get the service for about four years. that will give it time to wind up the supreme court to get a decision. in the meantime, everyone has to pay night. so the government can collect money and the question is are we gonna get a refund if -- i don't think!

>> people are getting benefits. that's a great point. people aren't going to get benefits for three, four years but the costs start right away. you are right. >> greta: that's not happening. >> i still think this idea they are voting on something they don't note constitutionality of is contrary -- when they come to congress, the first thing they do when they come to capitol hill they stick their hand on that bible and swear to uphold the constitution. how are they doing it in this bill. >> greta: president obama has made two offers that says come see me and the congressman says i would love to. and he will tell the white house said thoeufpl stunning in terms of transparency. >> they promised this would come at lower cost and expand coverage and it looks like it is doing neither. >> greta: steve, thank you. next, three danger zones.

streets. of course people are screaming for help among the rubble. the un headquarters reportedly seriously damaged and a major hospital collapsed. haiti is in darkness tonight z haiti is one of the poorest countries in the world casualties are expected to be very high. and united nations john bolton joins us live. ambassador... what do you think the u sn. doing tonight to mobilize to help this poor country? >> i suspect that the major part of the response will be or straighted by the united states and our foreign disaster assistance program given proximity of the united states i think we'll get assistance from other countries in the western hemisphere. i think the relief efforts will be led by the united states. >> and this is a country sure didn't need this. you know, earlier we talked about it. so poor. and buildings are flimsy. and imagine an earthquake of

this magnitude. >> it's poorest country in the western hemisphere. it's going to have a devastating affect. casualties will be high and lack of medical facilities and doctors and nurses and medical infrastructure just going to make it worse. >> and we won't know until daylight strikes tomorrow at the extent of what happened to this poor country. >> i expect our military will be involved in a major way just to get supplies in. and medicines and medical equipment. >> united states moves quickly on that stuff to help these countries. of these countries. north korea today says it is willing to conduct parallel talks on its nuclear program as long as we formally end the war that began in 1950 and they want the sanctions lifted. is this gonna happen? >> no, but this is a typical north korean effort.

we've had an armistice with the north koreans since 1953 they would like a formal peace treaty full recognition from thist and all this linked to the negotiations on their nuclear weapons program because in know they are better to negotiators and have been historically than the state department. they think they can use this as a way of extracting political benefits from the united states without giving very much. the state department has rejected this. i think that is obviously the right thing to do. the north koreans are not gonna give way on this. there's a lot of political symbolism and tangible political benefit to them and i think we can expect it to continue. >> greta: why not end the war? the war -- for all intends and purposes ended in 1953, the military action. we've had this armistice since 1953. what is the downside if weather pick some of these items and go from armistice to ending the military action?

we can't keep our military there or could we still keep them there? >> i think we would keep them there. i think the government of south korea was them. it may look like a technical matter recognizing the reality of the past 50 years. the fact is the north koreans have repeatedly violated the armistice agreement. would it be to their political advantage to gain the legitimacy to end the war, let's remember is against the united nations. our presence there technically is authorized by security council resolution. the north koreans see this as getting out of a burden that they've carried all these years. i'm not saying at some point we shouldn't resolve it but we ought to get something not give them more of what they want. >> greta: they also would have to lay down the sword as well in a peace thing, if we signed a peace agreement, wouldn't it be the same for north korea to say we are out of this too? just sign it.

>> this possibility has been there for over 50 years. i think what they are hoping for is not that we would have some kind of reciprocity and a deal but they would snooker the united states into ending the war, signing a peace treaty, granting diplomatic recognition before in gave away anything more on the nuclear program. they are good about this. they would say it is just a matter of timing. they have high confidence they can out-negotiate us. >> greta: iran, opposition leader was murdered, a bomb rigged motorcycle blew him up. now iran is saying that the united states was part of his murder along with israel. where does this -- why now? >> obviously, we don't know everything in connection with this. this particular scientist was nuclear expert, not clear if he was involved in iran's nuclear program. obviously, the government is trying to use this for its propaganda purposes.

pointing the finger at thist -- at the united states and israel. obviously wind the united states doing it using this kind of motorcycle bomb doesn't look to me like an israeli tactic. i think this could well be the government itself, the iranian government itself assassinating this person and blaming the u.s. and israel to give them a further excuse to crackdown against the opposition. >> greta: the news today, 69 drug murders in mexico in one day. drug-related, right on our border, what are we gonna do about mexico? >> the program that the bush administration started a few years ago, which in conjunction with the government of mexico, in effect to militarize the war against the drug lords, is still in its early stages. i think this is something we have to recognize is actually now becoming less of a law enforcement matter in mexico

and more of a real civil war against these drug cartels which are in a way, alternative forms of government. same is true down in colombia and really increasingly around the world. this is not a time to cutback. i think we ought to cooperate more with the government of cove. otherwise, these cartels, these -- these s are getting powerful enough to pose a real threat to the stability of the government of mexico. chavez and his ilk are not helping. if this instability kins and grows we -- we have a substantial problem now but it could keep getting worse. >> greta: i follow mexico everyday. everyday the drug-related murders are unbelievable, but 69 in one day tops all and it is extraordinary. ambassador, thank you sir. >> thank you. >> greta: next. john kerry firing off an e-mail saying he's trying to keep a tea party out of kennedy country. what does he mean?

joins us live here in washington. i don't know if which would go to lobbyists on the eve of the election when that's such a sensitive issue in these elects? i realize she has to make the money, but bad timing. >> democrats are starting to bring -- how badly the race has been run how she hasn't been aggressive. they are going to say she made a mistake to have a big fundraiser with lobbyists. >> greta: i've looked at the list. they are continuing. >> they are attending because they are scared that brown is going to pull off a miracle it would be a miracle. barack obama won that state by 26 points, 3-1 margin. for him to be close is really a miracle. now you see two polls that have him one the margin of error which is amazing. >> greta: a vote for him, is a vote in my mind for health

spending and debt and get of the federal government. massachusetts if you look at polls, people in massachusetts favor the health care bill. it is a lot of other things they are upset about, the debt and the other spending and the other aggressive growth of government in washington, d.c.. they already had universal coverage in massachusetts they have almost what obama's proposing. >> greta: if they've got almost full insured in massachusetts the health care bill is passed do they have to pick up the cost of the other states? >> yeah. >> greta: they've already paid for it, -- >> they have to pay twice. [ talking over each other ] >> greta: not to mention nebraska. that's the one thing that still confuses me whether that is true or not that seems to me -- >> they will get some money for their expansion of medicaid that will put it up to -- get some money but that

out of haiti. scene being described as a devastating earthquake in the area. the preliminary magnitude of the quake is 7.0. we have some images of the devastation, as you can see, a reporter telling us the capitol has been lrjly destroyed and casualties are severe ask wide spread. u.s. state department predicts a serious loss of life. homes and buildings are said to have been reduced to rubble and at this hour region is being rock by after shocks and the president says the under the circumstances sus ready to provide aid to the victims. the state department set up a toll free number for information about family members in haiti. details from the breaking story. we'll have more i'm ainsley earhardt back to greta. >> greta: on the record has been following this story for months. first the president extends invitation to go over health

care line by line. republican congressman fires off a letter saying i accept. then the white house ignores him, flat out ignores him. guess what? it just happened again. we went to capitol hill and the congressman went on the record. nice to see you sir. >> great to be back in washington. >> greta: i bet it is indeed. we were here last fall in late july, earth august the president said he would go line by line on the health care reform with anyone who wanted it. you wrote him a letter, have you heard back? >> we have not. we contacted his office on multiple times to sit down and go over this. the most important piece of legislation in the last 50 years. >> greta: they don't even respond. >> we haven't heard anything which makes you think we talked about before maybe there's a closed door deal. i think people at home over the holidays, i spoke to

hundreds, if not thousands of people they are concerned. they are afraid of what this government. >> greta: in terms of the health care bill you wrote one letter or two letters? >> actually three contacts. we used e-mail and snail mail, as we call it. we used multiple times and phone calls. >> greta: fast forward to december. the president said that -- december 10th, he's quoted as saying i'm committed to working with anybody willing to do the job to make sure we rebuild our economy. did you do anything in response to that? >> we wrote a letter about legislation we want to bring forward. you need to go -- people need to go out in this country and see what is going on. small businesses are failing. banks can't lend money. they tell you they are but i met with bankers they can't

lend money because the regulators have got the boot on their neck. i met with an owner of 18 burger kings. he said if this health care bill goes through the two in my community will close. >> greta: with the comment he made about the economy, did you send him a letter? >> we wrote a letter. >> greta: did you get a response? >> we have not. >> greta: when was that letter sent? >> in december. no response at all. >> greta: no call? >> no phone call. >> greta: they didn't say second time you have written us, too busy. >> we haven't her one thing. >> greta: are you willing to work with the president? he said he's looking to work with anybody willing to job to make sure we rebuild our economy. is it a stunt or are you willing to work with him? >> this is not a stunt i've been a physician, i had a medical practice, i came to work on these important issues. our people need work across the country.

i've talked to people in oklahoma, ohio, north carolina, town hall meetings, the questions are the same. where are the jobs? >> greta: we have issues with the economy, health, we've the issues of bad manners not even responding to your letters at all or any staff contacting you what's up? is not -- is this not any give-and-take? democrats are doing the whole thing? >> i think there is no bipartisanship. two things surprised me one was the spending and two was the partisanship this is not jobs are not a partisan issue. health care is not a partisan issue. i've never soon a democrat or republican heart attack. it is everybody's problem. we need to sit down on both sides. you would think on health care with over 10 physicians in the congress that someone would have sat down with the doctors and said what do you think about this legislation?
